General Terms and Conditions (GTC)
for the online shop GrowTastic GmbH

Note: These terms and conditions are based on Swiss law. In case of doubt, the current version published in the shop always applies.

1. Scope

These General Terms and Conditions apply to all orders that customers place via the online shop of GrowTastic GmbH (hereinafter “GrowTastic”, “we” or “us”). By completing an order you accept these conditions.

2. Offer and conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order. By clicking the “Buy” button, you are making a binding offer to conclude a purchase contract. The contract is concluded with our shipping confirmation or delivery of the goods.

3. Prices and Taxes

All prices are stated in Swiss francs (CHF) and include VAT unless otherwise stated. Shipping costs are shown separately.

Pricing Errors: Despite careful maintenance of our pricing, technical or human errors may occur. We reserve the right to adjust or cancel orders where there are apparent pricing errors. In such cases, we are not obliged under Swiss law to sell the goods at the incorrect price. In this case, we will inform the affected customers immediately and offer a fair solution (correction or withdrawal).

4. Payment methods

The following payment methods are available:

TWINT
Advance payment (bank transfer)
In the event of late payment, we reserve the right to charge reminder fees.

5. Delivery / Shipping

Deliveries are made to the address you provided. Delivery times are stated in the shop. We endeavor to adhere to the specified times, but accept no liability for delays beyond our control (e.g. caused by suppliers or shipping service providers).

6. Return and exchange policy

According to Swiss law, there is generally no general right of return.

Please check your goods immediately upon receipt. In the event of transport damage or errors on our part, we will of course assume full responsibility - in this case, the return or exchange will be at our expense.

If you order incorrectly or are not satisfied, please contact us immediately at info@growtastic.ch. We examine each situation individually.

Refunds will be made in the form of store credit. Shipping costs (postage) are borne by us, but a compensation of 10% of the order value will be deducted from the credit amount.

Returns must be requested in writing by email to info@growtastic.ch with reasons.

7. Liability

We are only liable for damage that was caused intentionally or through gross negligence. In the event of slight negligence, we are only liable for damages resulting from the breach of essential contractual obligations. Any further liability is excluded to the extent permitted by law.

8. Data protection

Protecting your data is important to us. You can find all information on the processing of personal data in our data protection declaration.

9. Applicable Law and Place of Jurisdiction

Swiss law applies exclusively. The place of jurisdiction is Heimenschwand (BE).

10. Final provisions

If individual provisions of these General Terms and Conditions are or become ineffective, the validity of the remaining provisions remains unaffected. Changes or additions to these terms and conditions must be made in writing.
